Please read these Terms & Conditions ("Agreement" or "Terms") carefully before using the photos.oneglint.com website (the "Site") and the oneglint mobile application or platform services (the "Application" or "Services"), operated by Oneglint Media Solutions Pvt. Ltd. ("oneglint," "we," "us," or "our").
By accessing the Site, registering an account, uploading selfies for photo searches, viewing event media, or purchasing digital downloads or products, you agree to be bound by these Terms. If you do not agree, please exit and discontinue using our Services.
1. General Agreement & Integration with Privacy Policy
These Terms constitute a legally binding contract between you ("User," "Customer," or "You") and oneglint.
Your access to and use of the Services is also conditioned on your acceptance of and compliance with our Privacy Policy, which is incorporated into these Terms by reference. Please read our Privacy Policy to understand how we collect, process, and share personal data, including our interactions with Event Organizers and data processors.
2. Intellectual Property & Ownership
- Platform Ownership: The Site, Application, proprietary search algorithms, software, trade dress, trademarks, and user interfaces are the exclusive property of Oneglint Media Solutions Pvt. Ltd. and are protected by applicable intellectual property laws.
- Media Ownership: Photos, video clips, and event media featured on photos.oneglint.com are owned by oneglint, participating Event Organizers, or licensed photographers, and are protected by international copyright laws.
3. Authorized Use of Photos & License Grant
- Personal License: Upon purchasing or downloading media from photos.oneglint.com, you are granted a non-exclusive, non-transferable, personal-use license to view, store, and display the downloaded photographs and video clips for personal, non-commercial purposes.
- Prohibited Uses: You may not:
- Reproduce, re-license, resell, distribute, or commercially exploit any media downloaded or obtained from the platform without explicit written consent from oneglint or the copyright holder.
- Use any photograph or video clip to suggest an affiliation with, endorsement by, or sponsorship of any brand, individual, or entity without authorization.
- Modify, alter, reverse engineer, decompile, or disassemble any software, facial matching technology, or watermarking protocols on the platform.
4. Event Media & Facial Recognition Search
- Role of Event Organizers: photos.oneglint.com provides platform infrastructure for Event Organizers. Event Organizers are responsible for obtaining participant consent for event photography and media upload.
- Selfie Uploads for Photo Matching: When you upload a selfie or reference image to search for your event photos, you represent and warrant that:
- The image uploaded is your own likeness, or that you have explicit legal authorization from the subject (or parent/legal guardian in the case of a minor) to upload the image.
- You will not upload photos of third parties without authorization or use the facial recognition feature for stalking, harassment, or unauthorized identification.
5. Digital Downloads, Pricing, & Refund Policy
- Pricing & Display: We make every effort to display product pricing, digital file formats, and color representations accurately. However, actual photo rendering and colors depend on display hardware and monitor settings.
- Non-Refundable Digital Goods: All sales of digital downloads, digital media access, and online photo delivery packages are final and non-refundable once access is granted or digital files are made available for download.
- Re-delivery & Technical Assistance: If you encounter technical difficulties downloading your purchased pictures/video clips after completing checkout:
- Please contact us at support@oneglint.com within 7 days of purchase.
- We will happily regenerate and resend access links to the registered email address used during ordering.
- Discretionary Refunds: If a non-digital refund or duplicate payment correction is approved by oneglint management, it will be processed within 12 to 15 business days back to the original payment method.
6. Disclaimer of Warranties
EXCEPT AS EXPRESSLY PROVIDED OTHERWISE, THE SITE, APPLICATION, AND ALL MEDIA CONTENT ACCESSED OR PURCHASED THEREFROM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ONEGLINT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. ONEGLINT DOES NOT GUARANTEE THAT ALL EVENT PARTICIPANTS WILL BE CAPTURED IN EVENT PHOTOGRAPHS OR THAT FACIAL MATCHING RESULTS WILL BE 100% EXHAUSTIVE OR ERROR-FREE.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ONEGLINT MEDIA SOLUTIONS PVT. LTD., ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH:
- YOUR USE OF OR INABILITY TO USE THE SITE, APPLICATION, OR MEDIA;
- UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA;
- STATEMENTS OR CONDUCT OF ANY EVENT ORGANIZER OR THIRD PARTY ON THE SERVICE.
IN NO EVENT SHALL ONEGLINT'S TOTAL AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU TO ONEGLINT FOR THE SPECIFIC SERVICE OR DIGITAL MEDIA PURCHASED IN DISPUTE.
8. Indemnification
You agree to indemnify, defend, and hold harmless Oneglint Media Solutions Pvt. Ltd., its directors, officers, employees, affiliates, licensors, and Event Organizers from and against any claims, liabilities, damages, losses, expenses, or legal fees (including reasonable attorneys' fees) arising out of or related to:
- Your breach of these Terms or Privacy Policy;
- Unauthorized commercial use or distribution of media obtained from the platform;
- Uploading selfies or images without proper authority or legal consent.
9. Governing Law & Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of India. Any legal action, suit, or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.
10. Modifications to Terms & Service
We reserve the right to modify or replace these Terms at any time without prior notice. The updated version will be posted on this page with a revised "Last Updated" date. Your continued use of the Site or Application following any changes constitutes your binding acceptance of the updated Terms.
